Design Ownership
All custom work designed by AARKS Customized Web Design, LLC is unique and will not be duplicated for another business or individual. All Pre-made themes are however available for duplicate sale and are not unique to the client. The designer retains personal rights to use the completed project and any preliminary designs for the purpose of design competitions, future publications on design, educational purposes and the marketing of the designer’s business. Where applicable the client will be given any necessary credit for usage of the project elements.
Confidentiality
All correspondence and documents provided will be kept confidential between the client and the designer, unless consent has been granted by both parties involved.

AARKS Customized Web Design, LLC has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by AARKS Customized Web Design, LLC of the site. Use of any such linked web site is at the user’s own risk.

AARKS Customized Web Design, LLC will not design, build or host any websites with offensive or adult content. Our websites are professional & family oriented and it is important to include websites that are appropriate for all viewing ages.
Cancellation & Return Policy
In the event of cancellation of the website project, once a written agreement is given to AARKS Customized Web Design, LLC and due to the nature of digital online work, we will not accept any type of return or offer any refunds.
Proofing of Final Project
The designer will make every effort to ensure the final product is free of any errors, before giving the final product to the client. It is the client’s responsibility to ensure that there are no visible errors contained in the final product. It is agreed that the designer is not responsible or held liable for any errors contained in the final product after the final product has been committed to print or posted in view of the public. Client will send a signed approval prior to final posting of website.
Please Note: Within seven (7) days of completion of the project any errors or problems with a design or website must be reported. After the 7 days fees an hourly rate will be applied to any revision.
Disclaimer of Warranties
AARKS Customized Web Design, LLC assumes no responsibility for errors or omissions in these materials. THESE MATERIALS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Indemnity Agreement
The client further agrees to indemnify and hold harmless AARKS Customized Web Design, LLC for claims of any nature whatsoever pertaining to the services and goods provided. This includes the loss of customer furnished proofs and materials, loss of profits, business interruption, and loss of any information stored in AARKS Customized Web Design’s computers. Additionally, this Indemnity Agreement includes claims relating to any software or other copyrightable materials furnished by the client, and from any and all copyright claims and/or misappropriations of trade secrets and/or any claim of theft of proprietary information.
